Elisaveta Talpis sought help for domestic violence before an attack in which her son was killed and she survived an attempted murder.
What the Court found
In its judgment of 2 March 2017, the European Court of Human Rights found violations of Articles 2 and 3, and Article 14 taken with those provisions. The case examined the authorities’ lack of a sufficiently prompt response and the effects of their passivity.
From formal rights to effective protection
A legal framework alone is not the same as timely implementation. This case raises questions about risk assessment, coordination and acting on complaints. It should be understood as a finding about these particular circumstances, not a statement that every failure to prevent harm automatically establishes a Convention violation.
